إذا صدر الحكم بعد إعادة المحاكمة قاضيا بالبراءة ، وجب التصديق عليه فى جميع الأحوال ، وإذا كان الحكم بالإدانة جاز للضابط المصدق أن يخفف العقوبة أو أن يوقف تنفيذها أو يلغيها وفقا لما هو مبين فى المادة السابقة . كما يجوز إلغاء الحكم مع حفظ الدعوى .
