إذا كانت العقوبة المحكوم بها تخرج عن سلطة الضابط المصدق فعليه أن يرفعها إلى السلطة الأعلى المختصة وفقا لأحكام هذا القانون .
ومع ذلك يجوز للضابط المصدق أن يخفف هذه العقوبة أو يحذفها أو يستبدل عقوبة أخرى بها إن كان هناك وجه لذلك بحيث تصبح من العقوبات التى يمكنه التصديق عليها بنفسه .
