(مادة 3 مكررا): لا يسرى حكم المادة السابقة على سلطة النيابة العامة طبقا للقانون فى رفع الدعوى والتدخل فيها والطعن على أحكامها، كما لا يسرى أيضا على الأحوال التى يجيز فيها القانون رفع الدعوى أو الطعن أو التظلم من غير صاحب الحق فى رفعه حماية لمصلحة شخصية يقررها القانون.
