إذا كان القانون الواجب التطبيق فى مسائل الأحوال الشخصية يحدد للخصم ميعادا لاتخاذ صفة كان له أن يطلب تأجيل الدعوى حتى ينقضى هذا الميعاد وذلك دون إخلال بحقه فى إبداء ما لديه من دفوع بعد انتهاء الأجل .
