A cassation appeal against a civil judgment must generally be filed within 60 days. The appeal and its grounds must be lodged within that period. 2 3

The starting point depends on the judgment and the applicable procedural rule:

- For a judgment given after a hearing, the period runs from the date of judgment. 5 - If the judgment is in absentia and open to opposition, the period does not begin until opposition is no longer admissible. 5 - In the circumstances specified in Article 213—such as the defendant’s absence from all scheduled hearings without filing a defence memorandum, or a judgment issued after a cause of interruption without bringing in the successor—the period runs from service of the judgment. 1 - A judgment’s date of service therefore controls only where the statutory conditions for service-based commencement apply. 1
