فى تطبيق الأحكام الخاصة بالمفقودين المنصوص منها فى هذا القانون يعتبر الاستشهاد أو الوفاة من تاريخ الفقد بالنسبة للأحكام الخاصة بصرف المعاش والمنحة العاجلة وتحديد المستحقين لهما ، ومن تاريخ ثبوت الاستشهاد أو الوفاة طبقا لنص المادة (٣٨) بالنسبة لصرف باقى المستحقات المنصوص عليها فى هذا القانون وتحديد المستحقين لها ، وذلك مع مراعاة ما ورد بشأنه نص خاص .
