يعتبر مستشهدا فى حكم هذا القانون كل من يتوفى بسبب العمليات الحربية فى ميدان القتال أو متأثرا بإصاباته بعد نقله منه .
وتسرى أحكام الفقرة السابقة على من يتوفى فى إحدى الحالات المنصوص عليها بالمادة ( ٣١ ) إذا كان قد تصدق له مسبقا بالقيام بها وكانت الوفاة بغير إهماله .
