يشترط لاستحقاق التأمين الإضافى فى حالة انتهاء الخدمة لعدم اللياقة الصحية ألا يكون المنتفع قد حصل على تعويض عن ذات إصابته قبل انتهاء خدمته يعادل أو يزيد على مبلغ التأمين الإضافى المنصوص عليه بالمادة (٧٨) فإذا كان قد استولى على تعويض أقل من مبلغ التأمين الإضافى المشار إليه أدى إليه الفرق .
