يقدر مجلس النقابة أتعاب العضو بناء على طلبه أو طلب العميل وذلك عند عدم الاتفاق عليها كتابة أو اذا كان هناك إتفاق كتابي وحدث اختلاف على تقدير قيمة الأتعاب بسبب يتعلق بالمهنة . ولا يجوز رفع الأمر الى القضاء قبل عرض النزاع في الاتعاب على النقابة وإذا لم يصدر أمر التقدير خلال ستين يوما من تاريخ تقديم الطلب جاز الإلتجاء إلى القضاء .
