على صاحب العطاء الفائز تأسيس شركة ، تسمى "شركة المشروع" غرضها الوحيد
تنفيذ المشروع المعلن عنه ، وتحدد اللائحة التنفيذية لهذا القانون الشروط الواجب توافرها
فى شركة المشروع ، وحالات السماح لذات الشركة بتنفيذ عقود مشاركة أخرى بشرط
موافقة اللجنة العليا لشئون المشاركة ، كما تحدد الحالات التى يلزم فيها تقديم تأمين
نهائى وأسس تقديره وطريقة أدائه .
