كل من قبل وعدا أو عطية أو فائدة خصوصية كالبين في المادة ١٠٦ وهو يعلم السبب يحكم عليه بالحبس مدة لا تزيد عن سنة وبغرامة تقدر بحسب ما هو مقرر في المادة ١٠٨ إذا لم يتوسط بسعيه في الحصول على الرشوة .
