يعرض وزير العدل على المجلس المشار إليه فى المادة ٩٨ أمر الرؤساء بالمحاكم الابتدائية والقضاة ومن فى درجتهم من رجال النيابة العامة الذين حصلوا أو يحصلون على تقريرين متواليين بدرجة أقل من المتوسط و يقوم المجلس بفحص حالتهم فإذا تبين صحة التقارير أو صيرورتها نهائية بالتطبيق لنص المادتين ٧٩ ، ٨١ قرر إحالتهم إلى المعاش أو نقلهم إلى وظيفة أخرى غير قضائية .
