يعين رئيس هيئة القضاء العسكرى بقرار من رئيس الجمهورية من بين أقدم سبعة من أعضاء القضاء العسكرى، وذلك لمدة أربع سنوات أو لحين حلول الدور عليه للتقاعد أيهما أقرب، ولمرة واحدة طوال مدة عمله.
