للنيابة العسكرية أن تأمر بالإفراج عن المتهم فى أى مرحلة من مراحل التحقيق بما لا يتعارض وأحكام هذا القانون ، والأمر الصادر بالإفراج عن المتهم لا يمنع من إصدار أمر جديد بحبسه إذا وجدت ظروف تستدعى ذلك .
ولا يخل ذلك بحق السلطات المختصة فى اتخاذ الإجراءات التحفظية التى تراها .
