كل شخص خاضع لأحكام هذا القانون ارتكب الجريمة الآتية :
السلوك المضر بالضبط والربط ومقتضيات النظام العسكري .
يعاقب بالحبس أو بجزاء أقل منه منصوص عليه في هذا القانون .
ويشترط لإقامة الادعاء على مرتكب هذه الجريمة ألا يكون الفعل الذي ارتكبه مكونا لجريمة منصوصا عليها في هذا القانون .
