يفصل مستشار الإحالة في الأمر الصادر بالإحالة إلى المحكمة المختصة في استمرار حبس المتهم احتياطيا أو في الإفراج عنه أو في القبض عليه وحبسه احتياطيا إذا لم يكن قد قبض عليه أو كان قد أفرج عنه .
ويتبع عند الإفراج الأحكام الخاصة بالكفالة إذا رأى تعليق الإفراج على تقديمها " .
