للخصوم أن يطعنوا أمام محكمة النقض في الأحكام الصادرة من محاكم الاستئناف في الأحوال الآتية :
( ١ ) إذا كان الحكم المطعون فيه مبنيا على مخالفة للقانون أو خطأ في تطبيقه أو في تأويله .
( ٢ ) إذا وقع بطلان في الحكم أو بطلان في الإجراءات أثر في الحكم .
