يجوز عند الضرورة بقرار من وزير الإصلاح الزراعى وإصلاح الأراضى تجنيب أصحاب الملكيات التى تقع فى مناطق الاستصلاح فى مكان واحد وتعويضهم عنها عينا بأراضى أخرى مما يتم استصلاحه أو تعويضهم نقدا وفقا لأحكام القانون رقم ٥٧٧ لسنة ١٩٥٤ المشار إليه إذا استلزمت ذلك أعمال الاستصلاح .
وتحدد اللائحة التنفيذية شروط التجنيب وإجراءاته وقواعد التعويض العينى .
