تعتبر الأغذية فاسدة أو تالفة فى الأحوال الآتية:
(1) إذا كانت تركيبها أو تغيرت خواصها الطبيعية من حيث الطعم أو الرائحة أو المظهر نتيجة للتحليل الكيماوى أو المكروبى.
(2) إذا انتهى تاريخ استعمالها المحدد المكتوب فى بطاقة البيان الملصوق على عبواتها.
(3) إذا احتوت على يرقات أو ديدان أو حشرات أو فضلات أو مخلفات حيوانية.
