على الجهة الراغبة فى إنشاء ميناء تخصصى أن تتقدم بطلب بذلك إلى وزارة النقل والمواصلات، وترفق بطلبها خطة إنشاء الميناء، وتقوم الوزارة بإجراء الدراسة الفنية لتقدير مدى صلاحية إنشاء الميناء المطلوب، من حيث الموقع وإقامة المنشآت والتسهيلات الأرضية والمساعدات الملاحية اللازمة لخدمته.
وتخطر وزارة النقل والمواصلات الجهة الطالبة بالقرار الصادر بإنشاء الميناء، وتتولى الوزارة الإشراف الفنى على تنفيذ الميناء خلال فترة التنفيذ.
