When may a landlord seek to evict a tenant for unpaid rent under Law 136 of 1981?

A landlord may seek eviction for unpaid rent if the tenant fails to pay the rent due within 15 days after being formally required to pay, either by registered mail with acknowledgment of receipt sent without an envelope or by service through a process server. 1

The tenant can still prevent an eviction order by paying the rent due and the landlord’s actual expenses and costs before the court closes pleadings. If the tenant repeatedly fails or delays payment without reasons the court considers justified, the court is to order eviction or removal, as applicable. 1

Separately, where a summary-court eviction order is based on delay in payment under an express resolutive condition, it is not enforced if, at enforcement and in the tenant’s presence, the tenant pays the rent, expenses and fees. 1
