The ordinary appeal period for a civil or commercial judgment is 40 days, unless another law provides otherwise. For a judgment in an urgent matter, it is 15 days. 2
Ordinarily, the period starts on the date the judgment is issued. If the losing party was absent from all scheduled hearings and filed no defence memorandum with either the court or the expert—or was absent and filed none at all hearings after the case was resumed following a stay—the period starts when the judgment is served. The same service-based rule applies where proceedings were interrupted and judgment was issued without joining the person who succeeds to the deceased or otherwise affected party. Service for this purpose is on the party personally or at their original domicile. 1
A separate rule applies to a judgment that is in absentia and open to opposition: the period for challenging it does not start until opposition is no longer admissible. 8
