لا يجوز أن يعين مساعد خبير رأسا أو بطريق الترقية من وظيفة معاون خبير إلا إذا جاز امتحانا أمام لجنة مشكلة من :
( ١ ) مدير عام إدارة الخبراء .
( ٢ ) أحد المفتشين القضائيين بوزارة العدل .
( ٣ ) رئيس المكتب الفنى بإدارة الخبراء أو وكيله .
( ٤ ) مفتش القسم المختص بإدارة الخبراء .
