اذا عدل الطلب في الدعوى مجهولة القيمة أثناء سيرها الى طلب معلوم القيمة أو العكس ولم يكن قد سبق صدور حكم تمهيدي في موضوع الدعوى أو حكم قطعي في مسألة فرعية فرض رسم أكبر الرسمين .
و اذا صدر قبل التعديل حكم قطعي في مسألة فرعية عدا مسائل الاختصاص أو حكم تمهيدي في الموضوع فرض رسم جديد على الطلب .
