يصرف للمستحقين عن المفقود بسبب العمليات الحربية أو فى إحدى الحالات المنصوص عليها بالمادة (٣١) أو بسبب الخدمة معاش شهرى طوال مدة فقده يعادل ما يستحقونه عنه من معاش بافتراض استشهاده أو وفاته بحسب الأحوال ، وذلك اعتبارا من أول الشهر الذى فقد فيه .
