يعتبر المفقود بسبب العمليات الحربية أو فى إحدى الحالات المنصوص عليها بالمادة (٣١) فى حكم المستشهد كما يعتبر المفقود بسبب الخدمة فى حكم المتوفى بسببها وذلك بعد انقضاء أربع سنوات من تاريخ فقده دون أن تثبت وفاته رسميا أو وجوده على قيد الحياة .
وفى هذه الحالات يصدر قرار من وزير الحربية باعتبار المفقودين مستشهدين أو متوفين حسب الأحوال .
