يمنح المستحقون عن المستشهدين أو من فى حكمهم من المفقودين بسبب العمليات الحربية أو فى إحدى الحالات المنصوص عليها فى المادة ( ٣١ ) معاشا شهريا طبقا للفئات الموضحة بالجدول رقم ( ٢ ) المرافق أو يعادل آخر راتب استحقه المنتفع أيهما أفضل .
