إذا أفصحت محكمة ثاني درجة أو محكمة النقض باعادة القضية إلى المحكمة التي أصدرت الحكم المطعون فيه فلا تستحق رسوم جديدة عند الرجوع إلى الدعوى سوى الرسم المقرر على الإعلان " .
