ينشأ صندوق لموازنة أسعار الدواء - غير المعد للتصدير - وتكون له الشخصية الاعتبارية ، ويتبع وزير الصحة والسكان ، وذلك لتحقيق التنمية الصحية وضمان عدم تأثر تلك الأسعار بما يطرأ من متغيرات ، ويصدر بتنظيم الصندوق وتحديد موارده قرار من رئيس الجمهورية على أن يكون من بين هذه الموارد ما تقبله الدولة من مساهمات من الدول المانحة والمنظمات الدولية الحكومية وغير الحكومية .
