تعتبر الأقدمية فى الوظيفة من تاريخ شغلها ، فإذا اتحد تاريخ شغل الوظيفة لأكثر من موظف اعتبرت الأقدمية وفقا لما يأتى :
١ - إذا كان شغل الوظيفة لأول مرة اعتبرت الأقدمية بحسب الأسبقية فى التعيين طبقا لما ورد فى المادة (١٢) من هذا القانون .
٢ - إذا كان شغل الوظيفة بطريق الترقية اعتبرت الأقدمية على أساس الأقدمية فى الوظيفة السابقة .
