لا تسرى أحكام المادتين (١٧ ، ٢٠) من هذا القانون على الجهات والوظائف ذات الطبيعة الخاصة التى يصدر بتحديدها قرار من رئيس الجمهورية ، ويكون التعيين فى الوظائف القيادية والإدارة الإشرافية فى هذه الجهات والوظائف بقرار من رئيس الجمهورية أو من يفوضه .
ويكون شغل هذه الوظائف عن طريق الترقية بالاختيار وذلك على أساس بيانات تقويم الأداء ، وما ورد فى ملف الخدمة من عناصر الامتياز .
