مع عدم الإخلال بأحكام المادة (٧٦) من هذا القانون ، يجوز للموظفين الحاصلين على مؤهلات أعلى قبل الخدمة أو أثنائها ، التقدم للوظائف الخالية بالوحدات التى يعملون بها ، أو غيرها من الوحدات ، متى كانت تلك المؤهلات متطلبة لشغلها ، وبشرط استيفائهم الشروط اللازمة لشغل هذه الوظائف .
