يوضع المعين لأول مرة تحت الاختبار لمدة ستة أشهر من تاريخ تسلمه العمل تتقرر خلالها مدى صلاحيته للعمل ، فإذا ثبت عدم صلاحيته أنهيت خدمته ، وتحدد اللائحة التنفيذية أحوال وإجراءات عدم الصلاحية .
ولا يجوز نقل أو ندب أو إعارة المعين خلال فترة الاختبار .
ولا تسرى أحكام هذه المادة على شاغلى الوظائف القيادية والإدارة الإشرافية .
