تتولى إدارة الصندوق هيئة عامة تسمى الهيئة العامة للتأمين الصحي ، وتكون لها الشخصية الاعتبارية ، وتتبع وزير الصحة ، وتكون لها ميزانية خاصة ضمن الميزانية العامة للدولة ، ويصدر بتشكيل مجلس إدارتها وتحديد اختصاصاته قرار من رئيس الجمهورية بناء على عرض وزير الصحة بالاتفاق مع وزير التأمينات .
