إذا قبل الطعن فى صحة انعقاد الجمعية العمومية ، كانت قراراتها باطلة وتعين دعوتها للاجتماع مرة أخرى فى مدة لا تجاوز ثلاثين يوما من تاريخ قبول الطعن . كما تدعى كذلك خلال هذه المدة عند الحكم ببطلان انتخاب النقيب أو أكثر من ثلاثة من أعضاء مجلس النقابة ، لانتخاب من يحل محلهم ، أما إذا حكم ببطلان انتخاب ثلاثة أعضاء فأقل فيحل محلهم الأعضاء التالون لهم فى عدد الأصوات .
