اذا هدم الموصى العين الموصى بها واعاد بناءها علي حالتها الاولى ولو مع تغيير معالمها كانت العين بحالتها الجديدة وصية وان عاد البناء علي وجة اخر اشترك الورثة بقيمته مع الموصى له في جميع العين .
