اذا هدم الموصى العين الموصى بها وضم الارض الى ارض مملوكة له وبنى فيها اشترك الموصى له مع الورثه في جميع الارض والبناء بقيمة ارضة .
مادو 74 :
استثناء من احكام المواد 71 فقرة ثانية و72 فقرة ثانية و73 اذا كان ما دفعه الموصى او زادة في العين يتسامح في مثلة عادة الحقت الزيادة بالوصية وكذلك تلحق الزيادة التي يتسامح فيها اذا وجد ما يدل على ان الموصى قصد الحاقها بها .
