فى غير حالات التلبس بالجريمة ، لا يجوز اتخاذ أى إجراء من إجراءات التحقيق
فى الجرائم التى تقع من موظفى المصلحة ممن لهم صفة الضبطية القضائية أثناء تأدية
عملهم أو بسببه إلا بناء على طلب كتابى من الوزير أو من يفوضه .
وفى جميع الأحوال لا يجوز رفع الدعوى الجنائية عليهم إلا بعد الحصول
على هذا الطلب .
