يخضع عقد المشاركة لأحكام القانون المصرى ، ويقع باطلا كل اتفاق يتم على خلاف ذلك .
ويجوز بعد موافقة اللجنة العليا لشئون المشاركة الاتفاق على تسوية المنازعات
الناشئة عن عقد المشاركة بطريق التحكيم ، أو غيره من وسائل تسوية المنازعات غير
القضائية وذلك طبقا لما يتفق عليه فى عقد المشاركة .
