يكون الطعن فى صحة انعقاد الجمعية العمومية للنقابة الفرعية وفى قراراتها من حق خمسين عضوا ممن حضروها للجمعية العمومية للنقابة الفرعية وباقى الشروط والأوضاع المحددة فى المادة (٢٠) كما يجوز لوزير الصناعة الطعن فى صحة انعقاد هذه الجمعية العمومية وقراراتها طبقا لما ورد فى المادة (٢٠) ، وتسرى أحكام الفقرة الأولى من المادة (٢١) على هذه الطعون كما تسرى أحكام الفقرة الثانية فى حالة الحكم ببطلان انتخاب رئيس النقابة الفرعية أو خمسة من أعضاء مجلسها .
