تقوم بالتحقيق لجنة تؤلف من :
( ١ ) عضوين ينتخبهما مجلس النقابة كل سنة من بين أعضائه يكون أحدهما من شعبة المطلوب محاكمته .
(ب) عضو من مجلس الدولة بدرجة نائب على الأقل يختاره رئيس إدارة الفتوى لوزارة الرى .
