يجوز الامتناع عن منح ترخيص القيادة لمن سبق الحكم عليه في جريمة قتل أو إصابة خطأ بسبب قيادة مركبة وذلك خلال ثلاث سنوات من تنفيذ العقوبة أو سقوطها بمضى المدة ، أو من تاريخ الحكم إذا اقترن بوقف تنفيذ العقوبة .
وإذا حكم عليه مرة أخرى في إحدى الجريمتين المشار إليهما في الفقرة السابقة خلال ثلاث سنوات ، فلا يجوز منح ترخيص القيادة إلا بعد انقضاء ثلاث سنوات تحسب على الوجه السابق .
