استثناء من أحكام القانون رقم ٩٧ لسنة ١٩٧٦ بتنظيم التعامل بالنقد الأجنبي يكون للهيئة وشركاتها احتجاز قيمة المبالغ المدرجة في موازنتها التخطيطية بالنقد الحر لاستيراد احتياجاتها من السلع الوسيطة والاستثمارية ولسداد مصروفاتها غير المنظورة وسداد التزاماتها وذلك من حصيلة مواردها من النقد الأجنبي ، على أن يصدر بالقواعد المنظمة لذلك قرار من وزير الاقتصاد والتجارة الخارجية بناء على اقتراح وزارة الإنتاج الحربي .
