كل من تعمد فى زمن حرب الا ينفذ كل أو بعض الالتزامات التى يفرضها عليه عقد توريد أو أشغال ارتبط به مع الحكومة لحاجات الجيش أو الأهالى المدنيين أو ارتكب غشا فى تنفيذ مثل هذا العقد يعاقب بالحبس من شهر الى سنتين و بغرامة من ١٠٠ جنيه الى ٥٠٠٠ جنيه أو بإحدى هاتين العقوبتين .
وتطبق الأحكام نفسها على المقاولين من الباطن إذا وقع منهم عدم التنفيذ أو الغش فيه .
