يجازى بغرامة لا تتجاوز جنيها مصريا أو بالحبس مدة لا تزيد على أسبوع :
( أولا ) من اغتسل فى المدن أو القرى بحالة منافية للحياء أو وجد فى طريق عمومى وهو بهذه الحالة .
( ثانيا ) من وجد بحالة سكر بين فى الطرق العمومية أو فى المحلات العمومية .
( ثالثا ) من وجد فى الطرق العمومية أو المحلات العمومية أو أمام منزله وهو يحرض المارين على الفسق بإشارات أو أقوال. فإن كان المحرض المذكور لم يبلغ اثنى عشرة سنة كاملة يجازى أبواه بالعقوبات المقررة فى هذه المادة .
