يرسل قلم الكتاب ( الديوان ) ملف الطعن إلى النيابة العامة فورا وعليها إيداع مذكرة بأقوالها فى أقرب وقت مراعية فى ذلك ترتيب الطعون بالجدول ثم يعين رئيس المحكمة أحد أعضاء دائرة فحص الطعون مقررا ويحدد الجلسة التى تنظر فيها القضية ويخبر قلم الكتاب ( الديوان ) بها محامى الطاعن قبل الموعد بأسبوع على الأقل بكتاب موصى عليه ( مسجل ) .
