للخصوم أن يطعنوا أمام محكمة النقض فى أى حكم انتهائى — أيا كانت المحكمة التى أصدرته — فصل فى نزاع خلافا لحكم آخر سبق أن صدر بين الخصوم أنفسهم وحاز قوة الشىء المحكوم به سواء أدفع بهذا أم لم يدفع .
