للخصوم أيضا أن يطعنوا أمام محكمة النقض فى الأحكام الصادرة من المحاكم الابتدائية فى قضايا استئناف أحكام المحاكم الجزئية وذلك إذا كانت الأحكام المطعون فيها مبنية على مخالفة للقانون أو خطأ فى تطبيقه أو فى تأويله إذا كان الحكم صادرا فى مسألة اختصاص متعلق بولاية المحاكم .
