ومع ذلك إذا حكمت المحكمة بنقض الحكم المطعون فيه وكان الموضوع صالحا للحكم فيه جاز للمحكمة أن تستبقيه لتحكم فيه .
وإذا كان الطعن للمرة الثانية ورأت المحكمة نقض الحكم المطعون فيه وجب عليها الحكم فى الموضوع ولها عند الاقتضاء تحديد جلسة لنظره والأمر بضم الملف .
