إذا قضت محكمة النقض بعدم قبول الطعن أو برفضه حكمت على رافعه بالمصاريف وبمصادرة الكفالة ، وإذا رأت أن الطعن أريد به الكيد فلها أن تحكم بالتعويض للمدعى عليه فى الطعن .
